Shops and Establishment Registration

Register your shop, office or commercial establishment under your state Shops and Establishments Act, and keep the certificate current as headcount or address changes.

Overview

Shops and establishments are regulated by a separate Act in each state, administered by the state labour department or the local body. Registration (or a licence, called Gumasta in Maharashtra) records that a shop, office, restaurant or other commercial establishment is operating, and brings it under the state's rules on working hours, holidays, leave, wages and welfare. The registration is also often asked for by banks and by other registrations such as GST in some states.

Because the Act, portal, fee and validity differ by state, Zenith first fixes the state and the type of establishment and then prepares the filing for that state's portal.

Who needs it

  • Retail and wholesale shops, offices, IT and professional service firms, clinics and educational businesses run commercially.
  • Restaurants, hotels, banks, entertainment venues and similar commercial establishments.
  • Businesses that employ staff and need a record to show to labour officers.
  • Sole proprietors and firms who must show an address proof or a business registration to open a bank account.
  • Establishments in states where a small-business route or intimation is allowed for few employees.

What Zenith does

  • Confirms the state, local body and the headcount-based category.
  • Prepares the application, supports the owner's identity and premises documents and files on the state portal.
  • Handles queries, inspections where called, and downloads the certificate.
  • Sets reminders for renewal and shows how to update employees, address and owner changes.

Professional fees are customised; the state fee is shown separately in the quotation.

Eligibility and key rules

  • Any establishment operating from fixed premises falls under the state Act unless exempted.
  • Typical exemptions: government offices, factories regulated under the Factories Act, railway establishments, agriculture-only activity and non-commercial charitable or religious institutions. Each state defines its own list.
  • Registration is expected within a short period of starting. Sources read refer to windows of about 30 to 60 days, so the state's own limit applies.
  • Some states distinguish establishments by employee count; for example a small-establishment route may exist for fewer than 10 employees, and Maharashtra's Gumasta licence for 10 or more.
  • Validity and renewal vary by state; some issue for several years or on a lifetime basis, others require renewal every year.

Documents required

  • Identity proof of the owner or partners: Aadhaar, PAN, passport or voter ID.
  • Photograph of the owner.
  • Address proof of the premises: rent agreement or ownership document, plus utility bill or tax receipt, and a landlord NOC where rented.
  • For firms and companies: certificate of incorporation or partnership deed, PAN, board resolution and list of directors or partners.
  • Details of the establishment: name, nature of business, number of employees and date of commencement.

Process and timeline

  1. Zenith confirms the state portal and category.
  2. An account is created with the owner's mobile and email.
  3. The form and documents are submitted and the state fee paid online.
  4. The department verifies, and in some states inspects.
  5. The certificate is issued for download, often with a registration number to display at the premises.

Timelines depend on completeness, complexity and authority processing; sources read describe a period of roughly one to two weeks in many states.

Government fees, penalties and due dates

  • Fee: set by each state and often linked to employee count or the type of establishment. Zenith states the exact figure for your state in the quotation.
  • Renewal: due before the validity ends in states that need renewal. For Maharashtra's licence, sources describe renewal around 30 days before expiry and a late fee of half the renewal fee if delayed.
  • Maintaining registers of employees, hours, leave and wages and displaying the certificate are ongoing duties.
  • Non-compliance can lead to fines, cancellation of the registration and prosecution under the state law; the amount depends on the state.
  • Amounts and dates above reflect public sources read in October 2026 and change with notifications, so Zenith confirms the current figures in your quotation.

Common mistakes

  • Applying under the wrong state's Act or a branch in another state.
  • Delaying registration beyond the statutory window.
  • Not updating headcount, address or owner after a change.
  • Skipping the landlord NOC for rented premises.
  • Treating the shop registration as a substitute for a municipal trade licence or an FSSAI licence where those are also needed.
